This Friday, I drove to Denver, walked into the courthouse, and passed through the metal detectors. Took a jammed elevator to the fifth floor, dodged my way to the end of the hall, and slipped into the back of a courtroom. A young woman was on the witness stand testifying that her boyfriend showed up at her apartment after midnight, "ugly and drunk". They got into a fight about Trump. Then, he passed out in her bed.

She laid down and tried to get some sleep. He started peeing in her bed. She couldn't get him to wake up. So, she poured a beer over his head. Soaked in beer and his own piss, loverboy started another fight. She called the cops. He went to jail.

Now, in court, I was watching him get convicted of assault. But mostly I was hoping that during a break in the trial, I could grab the DA and talk to her about my client, Sarah.

There was no break. So, I closely watched the DA to scout her strengths and weaknesses in case we have to beat her in trial. She's young, a new lawyer, struts, maybe haughty, but I couldn't decide if it was true arrogance or insecurity. Her technique was sharp, solid, and unusually self-aware for a young lawyer, but maybe a bit chilly. If we face her in trial, I'll be warmer, kind, and engage the jury. I relaxed into my seat once I could see a way to beat her.

That didn't help the bed-wetter. He was found guilty, sentenced to six months of jail. The Court recessed.

The DA was packing up her files when I quietly approached. She had only a few minutes, but was pleasant (probably not arrogant) and agreed to hear my pitch. I politely handed her a stack of documents and a DVD, and, in a flat, even tone, delivered just the facts.

"Our client, Sarah, a young Canadian, works in a hospital as a nurse. Jimmy is from Alabama. He wrestled in the heavyweight class in college, before he dropped out. Now he works part-time, when he can.

I have handed you 247 pages of text messages they shared over the five months they had a relationship. Just a month after they met, Sarah sent a text to Jimmy telling him that Jimmy has threatened her, chased her down streets, assaulted her, and that Sarah will call the police on Jimmy and get a restraining order if he doesn't leave her alone.

In reply, Jimmy admits to her that 'This is the most abusive I have ever been' but promises that he will pray, seek guidance from God, and become a better boyfriend.

There are repeated texts from Sarah telling Jimmy to stop showing up at her apartment uninvited, and that when she finds Jimmy waiting alone inside her room, it freaks Sarah out. Jimmy texts an apology for standing outside Sarah's apartment door, and knocking on it for two hours while Sarah was hiding inside.

In this text, Sarah tells Jimmy to stop stealing her money. Jimmy replies that he didn't steal because he plans on paying her back, and sharing Sarah's money with him is okay because, 'I'm your man'.

Jimmy texts that he can't live without Sarah, and that when she wont see him, it feels like 'betrayal', drives him crazy, and that's why he's 'KILLED' in the past. Sarah tells him it's over, calls him a 'psycho', and tells him to stay out of her apartment and leave her alone.

Jimmy insists they must pray and talk. He ignores Sarah, and says they just need to work things out and he's coming over. He says that Sarah is being 'evil' to test Jimmy's devotion. Sarah responds, 'This is not a test...Leave me alone'. These texts go on and on for months."

The DA is now combing the 247 pages of texts. Her face is darkening slightly as if she's come upon a weather forecast for rain.

I hand the DA an affidavit and go on, "Jimmy completed a sworn affidavit for our office. He states, that Sarah has been trying to get rid of him for months. Jimmy would wait in the hallway outside their apartment for hours. And there were days when Sarah's housemate would come home and find Jimmy sitting alone in the apartment, without permission".

The DA flipped through the affidavit.

I said, "On April 2, 2017, Jimmy pushed his way into Sarah's apartment demanding that they talk and work on their relationship. Sarah told him to leave. Jimmy refused, saying that they loved each other too much to not work things out. Over Sarah's objections, Jimmy stayed there for the next three days, eating her food, taking her money, and insisting they just needed to pray.

On the morning of the fourth day, Sarah lost all tolerance.  She got up. Got dressed. Went to the couch where Jimmy was sleeping, flicked aside an empty bag of chips, and shook Jimmy awake.  Sarah told him, he had to go. Jimmy ignored her, and pretended he was asleep. Sarah shoved him and told him, he had to go. Jimmy started to comply, but then said today would be a good day for us to talk. Sarah told him, 'No way. Get out of my house!' But when the mountain of Jimmy's heavyweight wrestler girth finally rose from the couch, Sarah was pushed aside in his wake as he headed to the bathroom to piss.

Sarah was furious and followed him yelling that he had to go. Jimmy drained himself, looked at Sarah, then stripped to take a shower. Sarah lost her mind. Jimmy found this irritating. So, he grabbed Sarah, wrapped her up in a bear hug and squeezed. He told Sarah he had to restrain her because she wasn't listening, was becoming too upset, and just needed to calm down so they could talk. Sarah's arms were pinned, so she bit Jimmy on the collar bone and got her right arm free, grabbed a tube of toothpaste, and began hitting Jimmy. Jimmy thought that was funny, until Sarah broke free, returned with a fork, and threatened to poke him. Jimmy became serious, and stripped Sarah of the fork.

Sarah left the bathroom shouting that she was going for a knife, but she just ended up in the kitchen crying over what her life had become. When she finished, she called 911, and locked herself in her bedroom.

Police responded. Sarah was hysterical. Jimmy was calm and smooth like honey. Police arrested Sarah for assault."

I told the DA, "Since then, I have barred Jimmy from contacting Sarah. Despite this, Jimmy has continued to text, call, leave voicemails, and go to Sarah's apartment to wait in the hall or pound on her door. Five of Jimmy's voicemails are on the DVD, we have also attached a certified transcript for each of Jimmy's voicemails to Sarah." I handed the transcripts to the DA.

"In the transcripts, Jimmy tells David he is coming over, that she shouldn't listen to her lawyer, and that the charges are no big deal, just simple assault."

I tell the DA that we interviewed Jimmy at our office, "He signed an affidavit of non-prosecution (requesting that Sarah's case be dismissed). I asked Jimmy, 'Sarah says you told him that you have killed lots of people. Bad people?' Jimmy stared at me, looked both ways and said, 'Where are the bodies? Where is the evidence?'"

The DA shuddered.

Then I took a breath, settled, and closed, "Jimmy has also been sending things to Sarah. Just two weeks ago, before Valentine's day, Jimmy was inspired. He emailed Sarah this picture." I handed the DA a photograph. The message written on the picture is, "Miss my dick yet? Happy Valentine's Day!" The picture is a close up of Jimmy holding his erect penis.

The DA looked away to her right while making a deflating noise.

I said, "On Valentine's Eve, Jimmy emailed another picture." I handed the DA another photo. This one says, "I feel so shitty not being able to see you". The picture is a close-up of his shit floating in a toilet."

The DA was silent, but her face looked like she could smell the picture.

"Finally, on Valentine's day, Jimmy sent Sarah a video on Snapchat. Snapchat is designed to delete videos as soon as the recipient views them. But if you video the video with another camera, the video can be captured. Sarah recorded this video from Jimmy just a week ago."

I opened my laptop for the DA and started Jimmy's video. The DA watched. I narrated, "That is a close-up of Jimmy's penis...That is Jimmy masturbating...And that is Jimmy ejaculating into the camera." The video ended.

The DA looked away. She put a hand near her mouth, which seemed to be blowing out bad air. Her eyes searched a slow path across the ceiling, down the wall, and stopped on the floor.

A moment passed.

The DA said, "I assume your client wants the case dismissed."

"Yes", I said.

"Okay, I'll get back to you", she said.

Very politely, I said, "Thank you. Have a good weekend" and left.

Ceci, you peach, I've been up since 3. Viscious blizzard all night.

Now, I'm stopped on I-70 at the Divide, altitude 12,000 feet, sideways snow, wicked cold, and it's going to be GREAT!! Eight inches and still snowing hard on a Tuesday. Best ever because a big storm on a weekday keeps everyone at home or work. The entire range will be empty except for frosty lunatics!

And it is gorgeous!
